Terms of Service

These Terms of Service ("Terms") govern your use of ellisvelandia.com (the "Site"), operated by Ellis Velandia Caicedo, an independent Full Stack Developer based in Bogotá, Colombia. By browsing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

What this Site is

This Site is my professional portfolio and writing space. It exists to:

• Show the projects I have built and the technologies I work with.
• Share what I have learned through articles in the blog section — opinions, technical guides, and reflections on running a small independent practice.
• Let prospective clients reach me about new work via the contact form or by booking a discovery call.

Nothing on the Site is a finished commercial product. There is no marketplace, no paid subscription, no user-generated content area, and no commerce. The Site is informational and serves as a calling card for my freelance practice.

Ownership of content

All text, code samples, diagrams, project descriptions, screenshots and other materials on the Site are either created by me or used with the relevant licence and attribution. Unless explicitly noted otherwise, the content is copyright © Ellis Velandia Caicedo. The MIT, BSD, or Apache-licensed code in any embedded snippets remains under its original licence.

You may:

• Read, share, link to, and quote short passages with attribution.
• Translate or summarise an article for non-commercial use, with attribution.
• Use any technical example code freely under the MIT licence, unless the article explicitly states a different licence.

You may not:

• Reproduce entire articles or project case studies on other sites without my written permission.
• Use my name, photo, or likeness to imply endorsement of a third-party product or service without explicit written permission.
• Scrape the Site in bulk to train commercial AI models. The Site already publishes machine-readable signals in /robots.txt indicating that AI-training crawlers are not permitted.

Accuracy of the content

The articles and project descriptions reflect what I knew and believed at the time of writing. Software and standards move quickly: an article written about a framework last year may no longer be best practice today. I update major pieces when I notice them drift, but I cannot guarantee that any specific paragraph is current.

Treat anything on the Site as a starting point for your own research, not as professional engineering, legal, or financial advice. If you implement an approach you read here in a production system, verify it against current documentation and test it carefully.

Third-party links

The Site links to external resources — documentation, articles I respect, vendors I use, projects I have built for clients. I am not responsible for the content, privacy practices, or availability of any third-party site, and a link does not imply endorsement of the broader business behind it.

Limitation of liability

To the maximum extent permitted by applicable law, the Site and its content are provided "as is" without warranty of any kind, express or implied. I am not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site, including but not limited to losses caused by relying on an article that turned out to be outdated.

Nothing in these Terms limits my liability for fraud, gross negligence, or any liability that cannot be excluded under Colombian law.

Acceptable use

When interacting with the Site, you agree not to:

• Use the contact form, scheduling page, or any embedded service to send spam, threats, malware, or unsolicited commercial offers unrelated to my work.
• Attempt to gain unauthorised access to the Site's infrastructure, scan for vulnerabilities for non-authorised purposes, or interfere with how the Site serves other visitors.
• Misrepresent your identity in any communication initiated from the Site.

If you discover a security vulnerability in the Site, please report it responsibly to eyis619@gmail.com instead of exploiting it. I appreciate the help and will credit you publicly if you prefer.

Project enquiries are not contracts

Sending a message through the contact form, booking a discovery call, or exchanging emails does not create a contractual relationship. Any paid engagement begins only when both parties sign a written Statement of Work (or equivalent agreement) that sets out scope, deliverables, timeline, and price. Until that document exists, no obligation exists on either side.

Privacy

Your privacy is handled separately, in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference; together, they cover both how the Site behaves and how your data is handled.

Governing law and disputes

These Terms are governed by the laws of the Republic of Colombia, without regard to conflict-of-laws principles. Any dispute that cannot be resolved by good-faith discussion will be submitted to the competent courts of Bogotá, Colombia, unless mandatory consumer protection law in your country of residence assigns jurisdiction elsewhere.

Changes to these Terms

I may update these Terms when the way the Site works changes — for example, when I add a new feature or change a vendor. The "Last updated" date at the top reflects the most recent change. Continued use of the Site after a change means you accept the updated Terms.
